Terms of Service
1. Introduction
These Terms of Service (“Terms”) govern your use of the Newzy platform (app.newzy.eu). Christoph Mandl is the owner of Newzy and will be referred to as the “Owner” throughout this document.
2. Description of Service
Free Plan: Newzy is currently available free of charge under the Free Plan.
Pro Plan: A paid subscription plan (“Pro Plan”) may be introduced in the future. Pricing and features will be published in the web app.
Upgrade and Downgrade: Free Plan users may upgrade to the Pro Plan at their discretion. Pro Plan users may downgrade to the Free Plan at any time, subject to the terms described in the web app.
3. User Accounts
Registration: Registration is by invitation only.
Security: Users are responsible for keeping their login credentials secure.
Termination: Accounts may be terminated immediately for violations (e.g., illegal content or prohibited activities).
4. Intellectual Property
Ownership: All software, branding, and platform content (excluding user-generated content) are owned by the Owner of Newzy.
User Content License: Users retain ownership of their own content. By using Newzy, users grant the Owner of Newzy a non-exclusive, royalty-free license to host, process, and display their content solely for the purpose of providing the service.
5. Prohibited Activities
Illegal Content: Users must not distribute, create, or share illegal content, including hate speech, incitement to violence, or discrimination prohibited under Austrian law (including but not limited to Section 283 Austrian Criminal Code (StGB), the Prohibition Act (Verbotsgesetz), and other applicable Austrian anti-discrimination and criminal statutes).
Disinformation: Users must not create or share disinformation (intentionally false information) that is likely to cause public harm, as defined by EU and Austrian standards.
Hacking: Users must not engage in hacking, spamming, or unauthorized scraping of the platform.
6. Limitation of Liability
The service is provided “as is” and without warranties. The liability of the Owner of Newzy is limited to a maximum of €1,000, except in cases of intentional misconduct or where liability cannot be excluded under mandatory Austrian law.
7. Governing Law & Dispute Resolution
Governing Law: These Terms are governed by Austrian law, including the Austrian Civil Code (ABGB) and the Austrian Criminal Code (StGB).
Jurisdiction: Any disputes shall be resolved by the courts of Vienna, Austria.
8. Changes to Terms
The Owner may change these Terms at any time. Users will be notified of changes via in-app notifications. Continued use of the service after changes constitutes acceptance of the new Terms.
